Ugotovi se, da je tožeča stranka umaknila pritožbo.

Umik pritožbe ugotovi sodišče z izdajo ustreznega (ugotovitvenega) sklepa.

[OBRAZLOŽITEV]

Tožeča stranka je dne 22. 6. 2009 vložila pritožbo zoper sklep, naveden v uvodu tega sklepa.

Ker sodne takse ob vložitvi pritožbe ni plačala, predloga za oprostitev, odlog ali obročno plačilo sodnih taks pa ni vložila, jo je sodišče na podlagi 34. člena Zakona o sodnih taksah (Uradni list RS, št. 37/08, v nadaljevanju: ZST-1) s plačilnim nalogom za plačilo sodne takse opr. št. ... z dne 26. 6. 2009 pozvalo, da v roku 15 dni plača takso za pritožbo po tar. št. 30010 v znesku 33,00 EUR, z opozorilom na pravne posledice neplačila po določbah 105.a člena Zakona o pravdnem postopku (Uradni list RS, št. 73/07-UPB3 in 45/08) v zvezi z 22. členom Zakona o upravnem sporu (Uradni list RS, št. 105/06 do 26/07).

Tožeči stranki je bil plačilni nalog vročen 11. 7. 2009. Sodne takse v določenem roku ni plačala, zato se po določbi tretjega odstavka 105. a člena ZPP šteje, da je pritožbo umaknila, kar sodišče ugotavlja v izreku tega sklepa.
