The Supreme Court of Slovenia rejected the applicant's request for permission to appeal, ruling that the specific legal question regarding property acquisition was not decisive for the case. The applicant argued that the debtor's possession under a later-terminated contract should count toward their acquisition period, while the lower courts had dismissed the claim based on the applicant's alleged ownership rights. The court determined that even if the debtor's possession were considered, the acquisition period would be too short, and the applicant's ownership right does not affect the execution's admissibility. Consequently, the conditions for a revision under the Code of Civil Procedure were not met, leading to the dismissal of the request.

Zakon o pravdnem postopku (ZPP), 367.a odst. 1; 367.c odst. 2: A request for permission to appeal is inadmissible if the legal question raised is not decisive for the outcome of the proceedings, as the admissibility of execution is determined by the execution plan and not by the applicant's property rights acquired post-decision.

Zavrnitev predloga za dopustitev revizije, ker postavljeno vprašanje v tej zadevi ni pravno odločilno.

[OBRAZLOŽITEV]

Predlog se zavrne.

OBRAZLOŽITEV:
