Legislator summary

AI generated

The appellate court granted the appeal and revoked the first-instance decision that deemed the appellant's notice of appeal withdrawn. The appellant argued the notice was valid because they had paid the court fee, supported by documentary evidence. The court ruled that Article 497(3) of the Civil Procedure Act only applies when a party does not pay the fee, and no legal basis exists to treat failure to notify payment as equivalent to non-payment.

Pritožbi se ugodi in se izpodbijani sklep razveljavi.

Odločanje o stroških pritožbenega postopka se pridrži.

[JEDRO]

ZPP razveljaviti.

Izrek o stroških pritožbenega postopka temelji na (smiselno uporabljenem) 3.odst. 165.čl. ZPP.
