Legislator summary

AI generated

The appellate court dismissed the appeal and upheld the first-instance judgment suspending enforcement due to two unsuccessful auctions. The creditor argued the second auction date was incorrect, claiming only one auction occurred, but the court found evidence of a second failed auction scheduled for May 6, 1999. Since both auctions failed, the court correctly applied Article 95 of the Enforcement and Security Act to suspend the execution proceedings.

Pritožba se zavrne in se potrdi sklep sodišča prve stopnje.

[JEDRO]

V primeru neuspele tudi druge dražbe, sodišče ustavi izvršbo.

[OBRAZLOŽITEV]

Sodišče prve stopnje je z izpodbijanim sklepom zoper dolžnika ustavilo izvršbo. Pri tem se je sklicevalo na določbo 95. člena Zakona o izvršbi in zavarovanju - ZIZ.

Upnik se je zoper takšen sklep zaradi kršitve določb ZIZ in nepravilne ugotovitve dejanskega stanja pravočasno pritožil.

Predlaga, naj pritožbeno sodišče izpodbijani sklep razveljavi in zadevo vrne prvostopenjskemu sodišču v novo odločanje.
