Ugotovi se, da je pritožba umaknjena.

[JEDRO]

Sodišče druge stopnje do dneva, ko je bila pritožba umaknjena, odločbe še ni izdalo, zato je skladno z 2. odst. 334. člena Zakona o pravdnem postopku v zvezi s 15. členom ZIZ ugotovilo, da je dolžnik pritožbo umaknil.

[OBRAZLOŽITEV]

Sodišče prve stopnje je 30.08.1999 s sklepom odločilo, da se predlog dolžnika za odlog izvršbe zavrne.

Dolžnik se je zoper navedeni sklep pravočasno pritožil dne 16.09.1999, nato pa pritožbo dne 26.11.1999 umaknil.

Sodišče druge stopnje do dneva, ko je bila pritožba umaknjena, odločbe še ni izdalo, zato je skladno z 2. odst. 334. člena Zakona o pravdnem postopku, v nadaljevanju ZPP v zvezi s 15. členom ZIZ ugotovilo, da je dolžnik pritožbo umaknil.
