Legislator summary

AI generated

The appellate court dismissed the appeal and upheld the first-instance judgment ordering the defendant to pay a specific debt assumed from a third party. The defendant argued the contract was void under Article 47 of the Obligations Act because the debt subject was indeterminate, but the court found the debt clearly defined by the contract's terms and payment schedule. Consequently, the court rejected the invalidity claim and confirmed the lower court's decision based on the precise identification of the debt obligation.

Article 47 of the Obligations Act; Article 2 and 6 of the Debt Assumption Contract: A debt assumption contract is void only if the debt subject is indeterminate; however, if the debt is clearly defined by the contract terms and payment details, the contract remains valid and enforceable.

365. člena ZPP) je preizkusilo sodbo prve stopnje še glede bistvenih kršitev določb pravdnega postopka iz 2. odst. 354. člena ZPP, a ni našlo nobene. Zato je po določbi 368. člena ZPP neutemeljeno pritožbo zavrnilo in potrdilo izpodbijano sodbo.
