Umik pritožbe se vzame na znanje.

[JEDRO]

Kadar stranka umakne pritožbo, zadeva pa je bila predložena pritožbenemu sodišču, dejstvo umika sodišče druge stopnje s sklepom sprejme na znanje, če ni že prej izdalo sodne odločbe.

[OBRAZLOŽITEV]

S sklepom z dne 23.4.1999 je sodišče prve stopnje izreklo, da se predlog za ureditev meje šteje za umaknjenega ter v tej posledici odločilo, da se nepravdni postopek ustavi.

Proti temu sklepu je vložila pritožbo C. Z., vendar jo je z vlogo z dne 27.9.1999 umaknila. Dejstvo, da je C. Z. umaknila pritožbo, je sodišču druge stopnje narekovalo, da je s tem sklepom sprejelo umik pritožbe na znanje.
