The appellate court allowed the appeal and revoked the first-instance judgment, ordering a retrial. The plaintiff argued the lower court violated procedural rules by failing to provide reasons for a decisive fact regarding the debt's discharge. The court found that because the judgment lacked reasoning on this material fact, it constituted a significant violation of the Civil Procedure Act, necessitating the revocation.

VSL sodba I Cpg 813/2010
Appeal allowed; appeal admissible only for procedural errors in small value disputes; appeal dismissed for untimely objection to evidence. Small value disputes allow appeals only for specific procedural errors. Parties must object to procedural violations immediately. Failure to object at the critical moment of evidence conclusion bars later claims. The court found a fundamental procedural error regarding the explanation of work orders versus invoices. The court reversed the first-instance judgment and remanded the case for a new trial. The appeal was partially allowed regarding the procedural error but dismissed for other claims. The court ruled that the first-instance court failed to explain discrepancies between work orders and invoices. The court held that the appellant's failure to object to the evidence ruling was a waiver. The court determined that the procedural error was so fundamental it could not be corrected on appeal. The court found that the first-instance court's reasoning regarding work orders was insufficient and unclear. The court concluded that the case must be retried to address the procedural defect properly.

Pritožbi se ugodi in se sodba sodišča prve stopnje opr. št. I Pg 362/91-6 z dne 24.2.1993 razveljavi in vrne sodišču I. stopnje v ponovno odločanje.

Pritožbeni stroški so nadaljni pravdni stroški.

[JEDRO]

O tej dejanski odlagi pa izpodbijane sodbe ni mogoče preizkusiti, ker nima razlogov. Zaradi bistvene kršitve pravdnega postopka iz 13. točke II. odst. 354. člena ZPP, je pritožbeno sodišče izpodbijano sodbo razveljavilo in jo vrnilo v ponovno odločanje.

Izrek o stroških pritožbe temelji na določilu člena 166 ZPP.
