The appellate court dismissed the appeal against a first-instance judgment confirming an enforcement order for unpaid goods and interest. The appellant argued she did not owe money due to a supposed debt from company H and claimed she missed the hearing because she forgot the summons, though a return receipt proved she received it. The court rejected these assertions as unsubstantiated, noting the appellant failed to prove the alleged third-party debt or justify her absence, and emphasized that parties cannot succeed with baseless claims in court.

VSL sodba I Cp 126/2015
Appeal dismissed for failing to cite mandatory procedural limitations applicable to small value disputes. The court ruled that an incorrect legal instruction does not create a new appeal ground. The appeal was rejected because the appellant raised arguments outside the scope of permitted appeal grounds for small value disputes. The court held that a flawed legal instruction cannot establish a right to an appeal ground that is not legally permitted, as this would grant the party more rights than the law provides and result in unequal treatment of parties in other small value disputes. The appeal was therefore evaluated only within the framework of permitted appeal grounds and grounds the appellate court must examine ex officio. The appeal was dismissed as unfounded, and the first-instance judgment was confirmed.
