Ugotovi se, da je pritožba umaknjena.

[JEDRO] Če stranka svojo pritožbo umakne pred odločitvijo pritožbenega sodišča, le-to s sklepom ugotovi, da je pritožba umaknjena.

[OBRAZLOŽITEV] Tožnik je svojo pritožbo proti sodbi P 95/2004 Okrajnega sodišča v Novem mestu z dne 14.12.2005 s pisno vlogo dne 5.4.2005 umaknil pred izdajo odločbe sodišča druge stopnje (2. odst. 334. čl. ZPP). Zato je pritožbeno sodišče po ugotovitvi, da tožena stranka stroškov za odgovor na pritožbo ni zaznamovala, odločilo tako, kot izhaja iz izreka tega sklepa.
