The appeal court set aside the first-instance court's decision to treat interim proceedings costs as part of the main proceedings costs. The first court had stopped an interim boundary adjustment because it involved a property dispute to be resolved later, but incorrectly assigned the interim costs to the main trial. The court held that since the interim proceedings were terminated due to the applicant's fault, the costs must be adjudicated within the interim proceedings themselves, not merged into the future main action.

VSC sklep Cp 667/2010
Appeal dismissed; boundary proceeding halted because dispute concerns ownership rights, not merely boundary lines.
VSL Sklep II Cp 928/2023
Appeal dismissed; boundary dispute over building land requires ownership proceedings, not boundary adjustment.
VSL sklep II Cp 3318/2016
Appeal dismissed; boundary dispute is actually a property ownership dispute requiring full ownership assessment.
VSL sklep I Cp 523/2015
Appeal court dismisses tenant's claim and allows landlord's appeal regarding civil vs. non-contentious procedure. The tenant's right to a suitable dwelling is a matter for civil court, not non-contentious proceedings. The court ruled that the first-instance court erred by applying non-contentious rules to a dispute over the existence of the tenant's right. The appeal court held that the tenant's claim for a suitable dwelling must be adjudicated in civil proceedings, not non-contentious ones. The tenant's appeal was dismissed as inadmissible because it did not challenge the substantive decision but rather the procedural classification of the claim. The landlord's appeal was allowed because the first-instance court incorrectly applied non-contentious procedure rules to a civil matter. The court decided that the tenant's right to a suitable dwelling under the Housing Act is a substantive right to be determined in civil court, not a procedural matter for non-contentious proceedings. The appeal court dismissed the tenant's appeal as inadmissible since it did not challenge the substantive decision but rather the procedural classification of the claim. VSL sklep I Cp 2092/2015
Appeal court reverses first instance ruling, holding that disputed boundary line defines a boundary dispute, not ownership. The court clarifies that the size of the intermediate space is irrelevant to this classification.

Stroški pritožbenega postopka so del stroškov nepravdnega postopka.

[JEDRO]

ZNP).
