Legislator summary

The appeal was granted, resulting in the revocation of the first-instance court's decision and the remittal of the case for a new trial. The original court had rejected a request for exemption from court fees based on a provision of the Court Fees Act that was subsequently declared unconstitutional by the Constitutional Court. Consequently, the appellate court determined the lower court's ruling was unlawful and ordered a retrial where the fee exemption request would be evaluated under the current legal framework.

Pritožbi se ugodi, izpodbijani sklep se razveljavi in zadeva vrne sodišču prve stopnje v nov postopek.

[JEDRO]

Predlog za oprostitev plačila sodnih taks podjetnika posameznika v sporih v zvezi z njegovo dejavnostjo, naj sodišče prve stopnje obravnava v skladu z določilom 13. in 14.

V ponovljenem postopku naj sodišče prve stopnje obravnava predlog tožeče stranke v skladu z določilom 13. in 14. člena ZST in ker gre za spor majhne vrednosti, sklep razglasi na naroku in vzame v pisni odpravek odločbe o glavni stvari (tretji odstavek 447. člena ZPP).
