Legislator summary

AI generated

The Supreme Court of Slovenia rejected the plaintiff's request to transfer the case to another competent court. The plaintiff, representing the City of Ptuj, argued that the decision would set a precedent affecting other co-owners, including judges or their spouses. The court found no grounds for transfer as the only link between the local court and the municipality was geographical, and the alleged judge bias did not justify transferring the entire case.

Legislator headnote

Art. 67, 70 ZPP: A request for transfer of jurisdiction is denied when the only ground is alleged judge bias, as the court would first be required to declare all judges recused before considering a transfer under Art. 66 ZPP.
