The Supreme Court of Slovenia dismissed the appeal because the disputed monetary value did not exceed the statutory limit for allowing a review in commercial disputes. The plaintiff sought a monetary claim of 4,279,094.00 SIT (approx. 17,856.34 EUR), which was converted to euros at the official exchange rate of 239.640 SIT per EUR. The court ruled that since this amount remained below the 20,864.63 EUR threshold, the review was inadmissible under Article 490 of the Code of Civil Procedure. Consequently, the appeal was rejected, and each party bore their own litigation costs.

1. Revizija se zavrže.

2. Vsaka stranka sama krije svoje stroške revizijskega postopka.

[JEDRO]

Ker vrednost spornega predmeta ne presega mejne vrednosti za dovoljenost revizije, revizija ni dovoljena.

[OBRAZLOŽITEV]

2. Po določbi 490. člena Zakona o pravdnem postopku (ZPP) revizija v gospodarskih sporih ni dovoljena, če vrednost spornega predmeta glede izpodbijanega dela pravnomočne sodbe ne presega 20.864,63 EUR (prej 5,000.000,00 SIT).
