The Supreme Court of Slovenia dismissed the defendant's request for legal protection against a fine imposed by the border police. The defendant, acting as a sole proprietor, filed the request citing violations of the Constitution and the Offenses Act, arguing for the annulment of the first-instance judgment. The court ruled that only the public prosecutor has the right to file such a request, while defendants or others without standing can only submit a motion to the prosecutor, thereby rejecting the direct filing.

člena Zakona o kazenskem postopku (ZKP) v zvezi s 171. členom ZP-1), jo je na podlagi drugega odstavka 423. člena ZKP v zvezi s 171. členom ZP-1 zavrglo Vrhovno sodišče.
