The Supreme Court dismissed the appeal, upholding the first-instance court's decision to remand the case for a new administrative ruling. The lower court had correctly identified that the administrative body failed to valorize compensation according to market value laws and ordered a retrial. The appellant's request for the appellate court to directly resolve the land dispute was rejected because such a request does not constitute a valid claim for full jurisdictional decision-making under the Administrative Disputes Act.

Article 60(1)(1) of the Administrative Disputes Act; Article 61(1) of the Administrative Disputes Act: A request for the first-instance court to decide the case itself does not constitute a claim for a decision on the merits of a dispute with full jurisdiction, and the appellate court cannot rule on such a request in a full-jurisdiction dispute.

Sodba I Up 898/2005
Supreme Court dismisses appeal confirming first-instance judgment on denationalization procedural violations and standing. The court rejects arguments regarding procedural errors and standing in the denationalization process. The court held that the first-instance court committed a fundamental procedural violation by granting the plaintiff's appeal and overturning the defendant's decision, which required remanding the case for a new trial. The court ruled that the plaintiff's status as a party in the denationalization process was valid under the relevant laws, and the first-instance court's actions were a clear breach of procedural rules. The court decided to uphold the first-instance judgment's core findings while correcting the procedural error by remanding the case for a new trial. The court emphasized that the plaintiff's standing was not affected by the transfer of forests to the fund, as the law explicitly protects the rights of those who previously applied for denationalized property. The court concluded that the first-instance court's decision to grant the appeal and overturn the defendant's ruling was a fundamental procedural violation that necessitated remanding the case for a new trial. Pritožba se zavrne in se potrdi izpodbijana sodba.

[JEDRO]

člena Zakona o upravnem sporu (ZUS) ugodilo tožbi tožnice, odpravilo odločbo tožene stranke z dne 19.11.1998 in ji zadevo vrnilo v ponoven postopek. L., k.o. T. in k.o. V., občine K. z dne 22.1.1992 in odločila:

Tožnica v pritožbi uveljavlja pritožbena razloga bistvene kršitve določb postopka v upravnem sporu in zmotno uporabo materialnega prava.
