Pritožbeni postopek se ustavi.

[JEDRO]

Pritožbeno sodišče o pritožbi tožnika še ni odločilo, zato je po umiku pritožbe, na podlagi 2. odstavka 344. člena ZPP v zvezi s 16. členom ZUS, pritožbeni postopek ustavilo.

[OBRAZLOŽITEV]

Sodišče prve stopnje je z izpodbijano sodbo zavrnilo tožbo tožnika proti odločbi tožene stranke z dne 15.7.1997. Proti tej sodbi se je pritožil tožnik dne 15.12.1999. Tožnik je z dopisom z dne 12.4.2002 sporočil Upravnemu sodišču Republike Slovenije, Oddelku v Mariboru, da umika pritožbo proti sodbi tega sodišča št. U 2257/97. Sodišče prve stopnje je posredovalo navedeni dopis pritožbenemu sodišču dne 16.4.2002.

Zakon o pravdnem postopku (Uradni list RS, št. 26/99), ki se po določbi 16. člena Zakona o upravnem sporu (Uradni list RS, št. 50/97, 65/97 in 70/00) primerno uporablja za vsa vprašanja postopka, ki niso urejena s tem zakonom, v 2. odstavku 334. člena določa, da lahko stranka umakne že vloženo pritožbo, dokler sodišče druge stopnje ne izda odločbe. Pritožbeno sodišče o pritožbi tožnika še ni odločilo, zato je po umiku pritožbe, na podlagi navedene določbe ZPP, pritožbeni postopek ustavilo.
