Legislator summary

AI generated

The Supreme Court of Slovenia designated the Higher Court in Ljubljani to hear the appeal instead of the court that originally decided on it. The appellant, who challenged the first-instance judgment, was the son of the head of the civil department at the competent Higher Court. The court ruled that this familial relationship could reasonably cause doubts about the impartiality of the proceedings in the eyes of the opposing party and the public. Consequently, the court exercised its authority to transfer the case to ensure procedural fairness and public confidence in the judicial process.
