Kadar tožeča stranka umakne tožbo, ravna sodišče v skladu z določbo 28. člena ZUS ter postopek ustavi.

[OBRAZLOŽITEV]

Tožnica je s tožbo zahtevala, da sodišče odpravi odločbo tožene stranke, s katero je zavrnila pritožbo zoper odločbo prvostopenjskega upravnega organa, ki je odločil, da mora tožnica odstraniti rastlinjak, prizidek rastlinjaka in ograjo.

Tožnica je v vlogi z dne 15.1.1995 izjavila, da umika tožbo. Sodišče je zato na podlagi 28. člena zakona o upravnih sporih (Uradni list SFRJ, št. 4/77, 60/77), ki ga je na podlagi 1. odstavka 4. člena ustavnega zakona za izvedbo temeljne ustavne listine o samostojnosti in neodvisnosti Republike Slovenije (Uradni list RS, št. 1/91-I) smiselno uporabilo kot republiški predpis, postopek ustavilo.
