Legislator summary

AI generated

The Supreme Court of Slovenia rejected the plaintiff's request to recuse the presiding judge and transfer jurisdiction to another court. The plaintiff alleged bias based on observed friendly interactions between the judge and the defendant's lawyer, but the prior rejection of the recusal request already established sufficient objective impartiality. Consequently, the court found no weighty grounds under Article 67 of the Act on Civil Procedure Law to transfer the case.

Legislator headnote

AI generated

Article 67 of the Act on Civil Procedure Law; A request for transfer of jurisdiction to another court is only justified if there is a justified doubt regarding the objective impartiality of the judges, which was absent here as the prior recusal request was already rejected.

Predlog se zavrne.

[JEDRO]

Tožnica je istočasno predlagala izločitev predsednice sodišča in določitev drugega stvarno pristojnega sodišča.
