Legislator summary

AI generated

The Supreme Court of Slovenia rejected the High Court's proposal to transfer jurisdiction to the District Court where the defendant is employed. The creditor filed for enforcement proceedings, and the District Court suggested a transfer because the defendant works there, but the Supreme Court found this insufficient. The court ruled that without evidence of bias or other significant reasons, the current court must retain jurisdiction.

Article 67 of the Civil Procedure Act; A mere fact that the defendant is employed at the court hearing the enforcement proceedings does not constitute a weighty reason for transferring jurisdiction unless it raises doubts about impartiality.

Predlogu za prenos pristojnosti se ne ugodi.

[JEDRO]
