The High Court of Cassation and Justice, sitting as the panel for resolving questions of law, issued a binding legal interpretation establishing that a party may submit new evidence of the payment of court fees in an appeal against the dismissal of a request for such fees, even if proof was not provided before the closure of oral proceedings in the first instance. This decision resolved a reference for a preliminary ruling from a civil tribunal, addressing a procedural dispute concerning the admissibility of late evidence regarding the recovery of litigation costs. The court relied on Article 452 and Article 470 of the Civil Procedure Code, interpreted in light of its own Decision No. 9 of March 30, 2020, to clarify that the failure to prove fee payment at the first-instance stage does not preclude the submission of such proof via new writings during the appellate phase.

DECIDE:

521 alin. (3) din Codul de procedură civilă.
