The High Court of Cassation and Justice rejected as inadmissible the preliminary reference submitted by the Bucharest Court of Appeal, leaving the lower court to resolve the matter without a binding high-court ruling on the legal question. The dispute concerned the interpretation of the labor law provision regarding the minimum 20-working-day notice period for contract termination, specifically whether the day the notice is communicated to the employee counts as the first day of that period. The decisive legal basis involved Article 75(1) of the Labor Code and Article 521(3) of the Code of Civil Procedure, which governs the binding effect of the court's decision on the validity of the preliminary reference procedure.
