Survivor Pensions for War Victims: Cross-Reference Between War Victims Pension Law and Unified Public Pensions System Eligibility Conditions
Legislator summary
AI generatedThe High Court of Cassation and Justice’s Panel for Resolving Issues of Law, via a binding preliminary ruling, determined that the entitlement to a war widow’s or orphans’ pension under the Romanian War Victims Pension Law implicitly requires the fulfillment of all eligibility conditions set forth in the Public Pensions System Law, thereby resolving the referral submitted by the Bucharest Court of Appeal. The dispute concerned the interpretation of cross-referencing provisions in pension legislation, specifically whether the general conditions for survivor benefits applied to children of those deceased or disappeared in war or war invalids. Relying on Article 5(1) of Law No. 49/1999 and its interaction with Article 84 of Law No. 263/2010, the court established that the normative reference in the former law incorporates the substantive conditions of the latter, meaning beneficiaries must meet all statutory requirements under the unified public pensions system.
