The High Court of Cassation and Justice of Romania, through its Panel for the Settlement of Legal Questions, admitted the referral for a preliminary ruling and established that, in cases involving forestry workers employed under individual labor contracts, the pursuit of civil pecuniary liability under the Labor Code is mandatory to obtain an enforceable title. This decision resolves a legal dispute initiated by the Mureș Tribunal regarding the interpretation of Article 12 of Annex No. 1 to Forestry Law No. 46/2008 and its relationship with the 2014 decision of the Panel competent for appeals in the public interest. The court determined that the 2014 interpretation, which requires initiating labor law civil liability proceedings to secure an enforceable title against such employees, remains binding and applicable, thereby clarifying the procedural requirements for enforcing foresters' financial liabilities.
