Eligibility for in-kind compensatory measures in religious property retrocession claims involving post-1989 alienation
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted a recusal in the public interest filed by its governing body, establishing binding nationwide guidance that determines which parties are eligible for compensatory measures in kind. The dispute concerned the uniform interpretation of emergency decree no. 94/2000 regarding the retrocession of immovable property formerly belonging to religious institutions, specifically clarifying whether all claimants or only those whose properties were legally alienated after December 22, 1989, could opt for compensation under Article 5(5). The court held that the right to choose reparatory measures in kind is exclusively reserved for the owners of retrocession claims where the subject immovable property was legally transferred after the specified post-communist date, thereby restricting eligibility for this specific remedy based on the timeline of alienation.
