The High Court of Cassation and Justice, sitting as the panel for appeals in the interest of the law, admitted the appeal filed by the Presiding Council of the Cluj Court of Appeals and established a mandatory legal interpretation regarding the capping of salaries and allowances. The dispute concerned the scope of application of government emergency ordinances aimed at limiting compensation for public sector employees, specifically whether these caps extended to civil servants and contractual staff employed in local authorities' own structures (county councils, local councils, and local public institutions) despite the existence of a separate salary determination system for the "Administration" occupational family. Relying on Article 517(4) of the Civil Procedure Code, the court ordered that the provisions of Emergency Government Ordinance No. 226/2020 (Art. I(1)-(3)), Emergency Government Ordinance No. 130/2021 (Art. I(1)-(2)), and Emergency Government Ordinance No. 168/2022 (Art. I) are applicable to public servants and contractual personnel within local government apparatuses, overriding the framework of Law No. 153/2017 where it does not explicitly exempt such categories from the statutory salary caps.
