The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Prosecutor General and ruled, for uniform interpretation of Article 616(1) of the Civil Procedure Code, that entities governed by Government Ordinance No. 26/2000 on associations and foundations may include in their statutes, as a purpose and/or objective, the organization of activities specific to institutionalized arbitration only if they are authorized by the legislator to exercise institutionalized arbitration. The decision is binding pursuant to Article 517(4) of the Civil Procedure Code. The dispute concerned the statutory capacity of non-profit legal entities to conduct institutionalized arbitration, and the decisive legal basis was the principle that such activities require explicit legislative authorization, not merely statutory self-empowerment.
