Withdrawal of prior complaint in offenses prosecutable ex officio or by request
Legislator summary
AI generatedThe High Court of Cassation and Justice, through its Penal Law Questions Resolution Panel, admitted the reference submitted by the Brașov Court of Appeal and issued a binding interpretation that prevails over conflicting national case law. The dispute concerned whether criminal prosecution for offenses prosecutable either by the victim's prior complaint or ex officio must be treated as initiated via the prior complaint when such a complaint has already been filed, specifically regarding the legal consequences of withdrawing that complaint. The court held that in such mixed-prosecution scenarios where the victim has already filed a complaint, the action is legally considered initiated at the request of the victim rather than ex officio, thereby enabling the termination of proceedings upon withdrawal of the complaint under Article 158(1) of the Penal Code, with the decision becoming obligatory upon publication in the Official Monitor pursuant to Article 477(3) of the Code of Criminal Procedure.
