The High Court of Cassation and Justice dismissed as inadmissible the reference of law submitted by the Bacau Court of Appeal, leaving the lower court's procedural posture unchanged and denying the requested binding legal interpretation. The dispute involved a civil enforcement proceeding where a creditor attempted to attach assets via a seizure against a third party that explicitly claimed it was not a "third party subject to seizure" due to its role as a service provider for a foreign electronic money institution, holding no obligatory relationship, debt, or funds for the debtor, and lacking the authority to issue or receive payment instructions. The decisive legal issue concerned the scope of the definition of a "third party subject to seizure" under Articles 781(1), 783(2), and 790(1) and (4) of the Romanian Code of Civil Procedure, specifically whether an entity that merely manages a collector account on behalf of a third-party payment institution and is contractually excluded from such status can be subject to enforcement.
