The High Court of Cassation and Justice, acting through its Full Bench for Resolving Legal Questions, admitted a reference from the Mureș Court of Appeal and issued a mandatory, binding interpretation regarding Law Decree No. 118/1990 on rights for political persecution victims. The dispute concerned the interpretation of Article 5, specifically whether children who were minors when their parents were resettled (strămutare) or born during such periods could claim specific benefits under paragraph 6, and how this interacted with the general rights granted to children under paragraph 1(e). The Court ruled that recognizing independent rights for such children under Article 5(6) effectively terminates the previous practice of granting them the same allowance under Article 1(1)(e), and further established that children of persons falling under the specific provisions of Article 5(6) are not eligible to benefit from the provisions of Article 5(7).
