The High Court of Cassation and Justice, through its Full Bench for resolving questions of law, issued a binding decision interpreting Article 6, points (b) and (c) of Law No. 153/2017, establishing that the principles of non-discrimination and equality permit the equalization of base salaries to the maximum level, including salary increases recognized by final judicial decisions, provided such benefits have general applicability within the same professional category and occupational family. This ruling resolves a preliminary reference initiated by the Court of Appeal, specifically addressing the procedural mechanism for unifying the interpretation of public sector salary legislation. The decisive legal basis rests on the mandatory nature of the Court’s interpretation under Article 521(3) of the Code of Civil Procedure, which dictates how equal treatment principles are applied to statutory salary grids in public employment disputes.
