The High Court of Cassation and Justice, sitting as the Panel for Resolving Legal Issues, issued a binding precedent under Article 521(3) of the Civil Procedure Code, clarifying the scope of terms in the Weapons and Ammunition Law. The dispute arose from a challenge to administrative decisions concerning the lawful holding or possession of weapons, where the applicant's status as a member of the armed forces was central to the legal analysis. The Court ruled that for the purposes of Article 13(2)(a) of Law No. 295/2004, the term "military" expressly includes "professional soldiers and NCOs" as defined in Law No. 384/2006. Consequently, the professional soldiers and NCOs fall within the specific regulatory regime for that category, establishing the legal basis for filtering cases involving the entitlement of professional military personnel to handle or possess firearms.
