The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling filed by the Court of Appeal of Constanta, leaving the lower court to proceed without a binding interpretation from the supreme instance. The dispute concerned the proper interpretation of Article 5 of Government Ordinance No. 105/1999, specifically whether the rights granted to individuals persecuted by the regimes installed in Romania between September 6, 1940, and March 6, 1945, for ethnic reasons, must be awarded starting January 1, 2024, or if the statutory extension of the deadline applies solely to the allowance regulated by Article 31 of the same ordinance. The court's decision was grounded in procedural admissibility criteria under Article 521(3) of the Code of Civil Procedure, which governs the prerequisites for seizing the full bench with a question of law, resulting in the rejection of the constitutional and fiscal administrative challenge without reaching the merits of the statutory interpretation.
