The High Court of Cassation and Justice (ICCJ) dismissed as inadmissible seven connected preliminary reference questions submitted by the Civil Section of the Harghita Court of Appeal, thereby declining to issue a binding legal interpretation; the procedural dispute concerned the admissibility of requests for a preliminary ruling on the interpretation of Article 13(8) of Law-Decree No. 118/1990, which grants rights to persons politically persecuted or deported by the communist regime starting from March 6, 1945. By rejecting the jurisdictional request, the court established that the specific legal interpretation sought did not meet the procedural requirements for the Supreme Court to exercise its power of unifying case law under Article 521(3) of the Code of Civil Procedure, leaving the lower courts' proceedings on the merits unaffected by this procedural ruling.
