The Supreme Court of Romania admitted a recusal in the interest of the law filed by the Court's Management Council, establishing a binding, mandatory interpretation for the unitary application of law in real property disputes involving religious institutions. The dispute centered on the scope of "immoveable properties belonging to religious cults" under the retrocession framework and whether a specific structure within a religious organization could prove its status as a former owner via indirect evidence. Relying on Art. 1(1) of Emergency Ordinance No. 94/2000 and Arts. 32–34 of Decree-Law No. 115/1938, the Court clarified that the phrase "properties belonging to religious cults" encompasses exclusively the patrimony of component units of the cults, excluding the patrimony of distinct establishments registered as tabular owners in the land register. Furthermore, interpreting Arts. 4(2)–(5) of the same ordinance, the Court ruled that a religious structure may only prove its status as a former owner—where the tabular owner was a distinct establishment to which it conferred a patrimonial mass of affectation through the division of its unique patrimony—by presenting direct evidence regarding the asserted legal situation.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

Completul pentru soluționarea recursului în interesul legii

Minuta deciziei nr. 21 Dosar nr. 2296/1/2023

Şedinţa din 13 noiembrie 2023

ÎN NUMELE LEGII

DECIDE:

517 alin. (4) din Codul de procedură civilă.

Pronunţată în şedinţă publică astăzi, 13 noiembrie 2023.
