Appeal in the interest of the law allowed: Affiliation of new sports foundation members ruled a statutory modification requiring registration to confer membership rights
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the management board of the Court of Appeal, establishing a binding interpretation that the affiliation of new members to a sports foundation constitutes a modification of the constituent act or statutes under Article 33 of Government Ordinance No. 26/2000, and that rights derived from membership are conditional upon the registration of this statutory modification in the Register of Federations. The dispute concerned the unitary application of laws regarding the legal status and administrative registration of non-profit sports entities, specifically whether adding new members triggers formal statutory amendment procedures or is a mere internal administrative act. The decisive legal basis comprises Articles 35 and 95 of Law No. 69/2000, Articles 6, 33, and 35 of Government Ordinance No. 26/2000, and Article 8 of the Regulation on the Register of Associations and Foundations (approved by Minister of Justice Order No. 954/2000), with the ruling issued mandatorily under Article 517(4) of the Civil Procedure Code.
