Conflicting safety distance standards for pyrotechnic articles under national explosive law versus transposed EU Directive 2013/29/UE
Legislator summary
AI generatedThe High Court of Cassation and Justice rejected as inadmissible the request for a preliminary ruling submitted by the Tribunal of Covasna in civil case no. 937/322/2022, thereby refusing to resolve the referred question of law and leaving the lower court to decide the matter without a mandatory preliminary interpretation from the supreme court. The dispute centered on a conflict between national legislation and EU transposition regarding safety distances for pyrotechnic articles, specifically whether the distance requirements should be governed by Article 34(2) of Law no. 126/1995 on the regime of explosive materials or by Annex 1 to Government Decision no. 1102/2014, which transposes EU Directive 2013/29/UE. The decisive legal basis for the rejection was the procedural inadmissibility of the initial submission, assessed under Article 521(3) of the Civil Procedure Code, which governs the mandatory nature and admissibility criteria of preliminary rulings in Romanian civil proceedings.
