The High Court of Cassation and Justice dismissed as inadmissible a request for a preliminary ruling on a question of law filed by the Arad Court of Appeal, leaving the lower court to resolve the underlying labor and insurance social case without a unifying Supreme Court interpretation. The dispute concerned whether an injured party, distinct from the contravenor, who ordered the demolition of a structure via a contravention report, could be assimilated to an injured party owning confiscated goods under Romanian law. The court’s decision relied on procedural admissibility standards, specifically citing Article 521(3) of the Code of Civil Procedure, to reject the referral rather than substantively interpreting the interaction between Article 31(2) of Government Ordinance No. 2/2001 on the legal regime of contraventions and Article 1(2) of the Civil Code regarding legal analogy.
