The High Court of Cassation and Justice dismissed the preliminary reference filed by the Bucharest Court of Appeal as inadmissible, leaving no definitive judgment on the merits and thereby preserving the procedural status quo in the underlying criminal case. The dispute centered on a tax evasion offense under Article 9(1)(c) of Law No. 241/2005, specifically challenging whether supplementary profit tax assessments could be calculated via estimation of expenses for which no justificatory documents exist, in accordance with Article 14 of the same law. The decision rests on the procedural admissibility requirements for preliminary references under Article 477(3) of the Code of Criminal Procedure, which renders the decision mandatory only from its publication in the Official Monitor, while failing to establish a binding principle of law on the substantive tax estimation issue.
