The High Court of Cassation and Justice of Romania (ICCJ) admitted the appeal in the interest of law filed by the appellate court, establishing a mandatory uniform interpretation of labor law provisions. The dispute concerned whether the employed staff of voluntary and private emergency services are automatically classified under special working conditions, thereby entitling them to specific benefits and leave regimes distinct from standard labor relations. The court ruled that such personnel are not "ope legis" included in the special working conditions category defined by Government Decision no. 1025/2003, and consequently, the specific provisions of Government Decision no. 1294/2001 and the Minister of Internal Affairs Order no. 283/2002 do not apply to them. The decisive legal basis for this outcome is Article 39(1) of Law no. 307/2006, which was interpreted to exclude this specific group of employees from the automatic application of special condition regulations.
