The High Court of Cassation and Justice admitted the appeal in the interest of the law filed by the Public Prosecutor, establishing binding unitary jurisprudence that the maximum fees for bailiffs as defined by Art. 39(1) of Law No. 188/2000 and Order No. 2,550/C/2006 do not include Value Added Tax (VAT) under Art. 265 of the Fiscal Code for services rendered in enforcement proceedings. This decision resolves a dispute regarding the tax treatment of statutory fee caps in compulsory execution, clarifying that VAT must be calculated separately and added on top of the maximum legal fee limits rather than being embedded within them. The ruling applies Art. 517(4) of the Code of Civil Procedure to render the interpretation mandatory, ensuring uniform application of the Fiscal Code and civil procedure norms concerning the financial liabilities of judicial bailiffs.
