The High Court of Cassation and Justice declined its subject-matter jurisdiction, ordering the case to be heard by the Alba Iulia Court of Appeal, effectively directing the parties to the lower appellate body for a substantive decision on their motion. The dispute involved a request for the transfer (strămutare) of a civil case originally pending before the Sibiu Court, initiated by the applicants on grounds of legitimate suspicion of bias. The court determined that under Article 142(1) of the Code of Civil Procedure, transfer requests challenging tribunals fall within the exclusive competence of the corresponding Court of Appeal; since the Sibiu Court is territorially within the jurisdiction of the Alba Iulia Court of Appeal, the High Court applied Article 132 of the Code of Civil Procedure to declinatory its own jurisdiction.
