The High Court of Cassation and Justice declined its jurisdiction and referred the case to the Constanța Court of Appeal, which prevailed as the competent forum; no merits decision was made. The petitioner had sought the transfer (strămutare) of a case pending before the Mangalia Court of First Instance, citing legitimate suspicion (bănuială legitimă). Because the underlying case was filed after the entry into force of the new Code of Civil Procedure and the court from which transfer was sought lies within the territorial jurisdiction of the Constanța Court of Appeal, the High Court held under Article 142(1) of the Code of Civil Procedure that the appellate court, not the High Court, has material competence to hear the transfer request; the ruling is final and without appeal.
