Admissibility of extraordinary appeal in the interest of the law challenging discrepancies between judgment dispositive and grounds under non reformatio in pejus
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the appeal in the interest of law filed by the Board of the Court of Appeal of Suceava regarding two questions of law concerning civil procedure. The dispute concerned the interpretation of Article 430(2) and Article 481 of the Code of Civil Procedure, specifically whether a discrepancy between the operative part and the grounds of a judgment is permissible under the principle of non reformatio in pejus, and whether the statutory phrase "cases expressly provided by law" for aggravating a party's situation in an own appeal is limited strictly to the exception of res judicata under Article 432 or extends to other absolute procedural exceptions. The court found the appeal inadmissible under Article 517(4) of the Code of Civil Procedure, leaving the procedural rulings of the lower instances in force.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE
Completul pentru soluționarea recursului în interesul legii
Minuta deciziei nr. 4 Dosar nr. 3036/1/2021
Şedinţa din 21 februarie 2022
ÎN NUMELE LEGII
DECIDE:
517 alin. (4) din Codul de procedură civilă.
Pronunțată în ședință publică astăzi, 21 februarie 2022.
