The High Court of Cassation and Justice dismissed as inadmissible the referral from the Bucharest Tribunal seeking a preliminary ruling on the interpretation of the terms "lands assigned for use" and "current holders of the right of use" under art. 36(3) of Land Law No. 18/1991, specifically whether these terms encompass de facto state abandonment of land to building owners following expropriation under art. 30 of Law No. 58/1974, or require formal allocation or lease acts, and whether the parties' real intent at contract conclusion should be considered. The court did not rule on the merits, leaving the referring case unresolved and providing no interpretation of the disputed legal provisions, as the referral was deemed inadmissible under the procedural framework for preliminary rulings.
