The High Court of Cassation and Justice dismissed the referral from the Court of Appeal Craiova as inadmissible, thereby leaving the matter unresolved by the high court. The dispute concerned a request for a binding interpretation under Article 521(3) of the Code of Civil Procedure regarding whether Article 484(1) constitutes an exception to the finality and enforceability of judgments in demolition cases, specifically where requests are filed under Law No. 50/1991 for unauthorized construction removal. The decisive legal basis involved the procedural admissibility of the referral mechanism for resolving questions of law and the substantive interplay between Article 484(1) and Article 483(2) read in conjunction with Article 94(1)(h) of the Code of Civil Procedure.
