Supreme Court adopts unitary interpretation that judges' daily allowance for delegation is based on actual working time, not calendar days.
Legislator summary
AI generatedThe High Court of Cassation and Justice, through its Plenary for Recourse in the Interest of the Law, admitted the recourse filed by the General Prosecutor, establishing a mandatory unitary interpretation that the daily allowance ("diurna") for judges, prosecutors, and similar magistrates delegated or seconded to other localities must be calculated based on the actual time worked, rather than the total number of calendar days within the delegation or secondment period. This decision resolved a dispute regarding the application of salary regulations, specifically challenging the method for quantifying travel allowances under Article 13(1)(a) of Emergency Government Ordinance No. 27/2006, approved by Law No. 45/2007. The court’s binding ruling clarifies that the decisive legal basis for filtering and applying this provision lies in the distinction between active working hours and calendar time for the purpose of calculating per diem allowances for judicial personnel.
