The Supreme Court of Cassation and Justice (ICCJ) admitted the appeal in the interest of the law filed by the Board of Directors of the Suceava Court of Appeal, establishing a binding interpretation that is mandatory for all courts under Article 517(4) of the Civil Procedure Code. This decision resolved a dispute concerning the procedural review of arbitral awards for enforcement, specifically clarifying the scope of judicial verification required when confirming an arbitral decision. The court held that the phrase "after verifying (...) compliance with the conditions" in Article 603(3) of the Civil Procedure Code strictly limits the court's review to formal conditions of the arbitral award, expressly excluding any substantive or "merits-based" (fond) examination of the underlying dispute.
