Whether mandatory mask-wearing in public spaces satisfies the aggravating element of acting as a "masked person" for qualified theft
Legislator summary
AI generatedThe High Court of Cassation and Justice admitted a preliminary ruling request and established that wearing a protective mask in public spaces where its use is mandatory constitutes the aggravating circumstance of a person being masked, thereby applying the qualified theft provision under Article 229(1)(c) of the Penal Code. This decision resolves a conflict of law raised by the Bucharest Court of Appeal regarding whether a mandate to wear face coverings during a pandemic satisfies the statutory requirement of a "masked" individual for the purpose of aggravating theft offenses under Articles 228 and 229. The operative legal basis is the interpretation that the physical hiding of one's features through mandatory public health equipment fulfills the definitional criteria for the "masked" circumstance, making this aggravator applicable to any theft committed under such conditions.
